Ernest Polak was the son of Marcus Polak and Engeltje de Jongh. Hij worked as a cantonal judge in Rotterdam. At 15 mei 1940, only several days after the German invasion, he committed suicide.

Ernest Polak schreef zich in 1906 in voor de studie geneeskunde aan de Universiteit van Amsterdam, maar stapte al snel over naar rechten. Daar promoveerde hij op 26 maart 1912 op het proefschrift "Artt. 240 en 451bis W. v. Sr. beschouwd in hunne verhouding tot kunst en wetenschap".
